Kurt is a litigation attorney with experience in real estate, title insurance defense and business litigation. Kurt represents both individual and institutional clients in a variety of areas such as foreclosing real property security interests, commercial and residential evictions, boundary disputes, business dissolutions and enforcement of construction liens. Kurt joined McEwen Gisvold as an associate in 2000 and became a partner with the firm in 2007.

Representative Transactions
Represented one joint venturer against a co-joint venturer in a business dissolution action. Kurt's client filed suit to dissolve joint venture and for the return of its contribution of 40-acres of real property. The joint venture was dissolved by the court and the client received back its contribution. The client was also reimbursed all of its attorney’s fees and costs incurred in the litigation.

Represented property owner and landlord of a downtown Portland commercial building in a tenant-eviction proceeding. After trial to the court, a judgment of eviction was entered against the tenant.

Represented lender in multi-state mortgage foreclosure proceeding. The client recovered the full amount of its debt by a junior interest-holder.

Represented lender in a case for conversion and impairment of security with respect to fixtures removed from secured property. Case settled with payment to the client.

Represented homeowner in arbitration regarding a construction defect case against a builder.  The arbitrator ruled in our favor with an award of $101,370 plus attorneys fees and costs.

Represented general contractor in the foreclosure of $500,000 in construction liens encumbering a 10,000 square foot home. Assisted client in negotiating a partnership agreement with junior claimant to obtain deed to property, refinance over $1,000,000 of the debt encumbering the property, and finish the construction of the improvement for later sale.

Represented employee to collect judgment against former employer. In a prior action, the employee had obtained a judgment against former employer, a small company. The judgment was likely uncollectible against the company due to lack of assets. In a second action for a creditor’s bill, employee obtained a judgment against the individual owner of the company since the company was undercapitalized and otherwise not following corporate formalities.

Professional & Community Activities
Kurt is an active member of the Oregon and Washington State Bar Associations and of the Multnomah County Bar Association’s Professionalism Committee. He also volunteers with the Campaign for Equal Justice and the Community Development Law Center’s pro bono services and previously served on the Board of Directors for the Friends of Beaverton City Library. For his performance at Gonzaga University School of Law, he received the CALI Award, which recognizes academic excellence.
