Representative Matters
Represented LLC owning shopping center in Chapter 11 bankruptcy. Successfully negotiated with creditors to confirm plan providing five years to refinance secured debt and twelve years to pay unsecured creditors.Selected as counsel for creditor's committee in Chapter 11 liquidation case of aircraft manufacturing company; work included drafting plan provisions for liquidating trust. Subsequently represented the liquidating trustee in administration and litigation to obtain dividend for unsecured creditors.Counsel for individual owner of assisted living centers, defending scores of actions against owner on guarantees. Eventually filed Chapter 11 bankruptcy case which led to case encompassing his numerous LLCs and partnerships.Represented attorney in defending and ultimately negotiating settlement of claim against attorney based on attorney's representation of credit union in settling construction lien claims and foreclosure of condominium project. Successfully appealed bankruptcy judge's order denying relief from dismissal of multiple preference adversary proceedings based on failure of debtor's attorneys to timely submit default judgments against defendants.Education
