McEwen Gisvold is pleased to announce that Alan Laster has joined the firm as a partner. Alan's expertise includes real property transactions, business law, and estate planning and administration. Partner Ray Streinz was recently chosen to represent the "Official Unsecured Creditors" Committee in the Chapter 11 bankruptcy case of Columbia Aircraft Manufacturing Corporation. Columbia, a manufacturer of high quality, general aviation aircraft, is based in Bend, Oregon. It had $90 million in sales last year, and has over $50 million in unsecured debt. In 2001, our client was sued by an adjoining property owner who claimed to own part of our client's property on the banks of the Alsea River in Oregon. In October 2007, after nearly 7 years of litigation (including two trials and an appeal to the Oregon Court of Appeals), the Lincoln County Circuit Court declared our client to be the true owner of the disputed property. Jonathan Radmacher and Kurt Kraemer handled this extremely complicated case, which required an examination of conflicting real property records dating back to the 1800's and a showing by clear and convincing evidence, the highest civil standard, that the disputed property had been historically used by our cilent and its predecessors and that their ownership extended beyond the strict boundaries of that use. On May 2, 2007, the Oregon Court of Appeals ruled in favor of McEwen Gisvold LLP's client, the Oregon School Activities Association. The Court of Appeals denied a challenge to the OSAA's statewide classification and districting plan brought by the Salem, Eugene and Medford School Districts. On March 23, 2007, Trung D. Tu, a litigation and appellate associate at the firm was named as one of the Portland Business Journal's Forty Under 40 for 2007 -- which is an award that recognizes 40 leading Portland business people who are under the age of 40. Trung was selected as one of the award winners because he has been an exceptional performer in the legal industry and in the community, he has influenced the Portland Metropolitan area with his civic and business accomplishments, and he has demonstrated that character, achievement and community involvement are consistent themes in his career. On March 5, 2007, Jonathan Radmacher represented the Oregon School Activities Association in arguments before the Oregon Supreme Court. Other Recent Successes: Reduction in Washington Department of Revenue B&O tax assessment against our client from approximately $160,000 to $3,000. Associates Erin Lillis and Hertsel Shadian obtained 501(c)(3) tax-exempt status for Architects Wihout Borders - Oregon and the Multiracial Family Resource Center.
